Here is a Foster contract we have put together for birds enetering our Foster Program. We are looking for opinions and suggestions incase we have missed or left anything out. Feel free to revise it or put anything in that we may have forgotten (the brains are overworked...LOL!) and send it back for final draft to be completed. Once we have everything that is needed in the contract, we will post it for all to use.

We have currently found a need for foster homes for bird owners who do not want to give up their birds because of temporary changes in their lives. I am currently fostering a MSCC for a woman who's living situation has temporarily changed.

Foster Agreement


This foster agreement is a binding agreement between___________________________________________________ and __________________________________________________ and is for the foster care of ____________________, not to exceed 6 months time. In the event that Owner fails to retrieve The
Bird on the date contract expires (unless contract is renewed 30 days prior to the 6 month expiration date), Foster Home will have the right to claim The Bird
for him/herself, the Agreement becomes null and void, as Foster Home
will become sole owner of The Bird with all responsibilities herein. The "Parties" agree to the following terms
and conditions, intending to be legally bound:




Section A



1. The Foster Home will foster Owners bird described below at his/her home located at the address listed at the bottom of this agreement, in
accordance with the terms and conditions in this Agreement.

Upon entering the Foster Home, Owner agrees that The Bird will:
a. Prior to entering foster home bird must be vet checked and have a clean bill of health or have proof of recent vet check
b. Not have been exposed to other birds, exotic or wild in the
past 6 months
c. Have it's' own cage, supplies and food
d. Bird Owner will provide all vet results and reports necessary for
verification.




The Foster Home



Foster Home will provide Fostering services, at no charge,
described below during the period from ___________________ through ___________________________. The Foster Home will Provide the Following:
a. Wholesome food and water daily (specific bird food provided by
Owner)
b. Warm, safe place inside the home
c. Clean cage
d. Supervised visits with Foster Home throughout the visit
e. Transportation to the vet in an avian approved carrier, when
necessary
f. Socializing and playing
g. Other: specific reasonable requests will be honored




Section B



The Foster home has experience and knowledge of different species of birds and takes every precaution to ensure the birds safety. Should vet care be needed or required it is agreed upon by both parties that all veterinary care and costs will be paid for by the owner of the bird during that 6 month period.



No liability. Foster Home is not liable to Owner or any other
persons for any human or companion animal bodily injuries or
illnesses, or any other damages, losses or injuries whatsoever in
connection with the actions, behavior or health of The Bird or in
connection with the Foster Home, except if caused by Foster Homes gross
negligence or intentional misconduct. Recoupment limited to fair
market valuation to be determined by an independent expert.




This Agreement is the entire Agreement between Foster Home and
Owner. Any modification to the Agreement must be made in writing,
signed by both parties. This Agreement binds the respective heirs,
executors, personal representatives, successors and assigns of
Foster Home and Owner.




The Foster Home acknowledges receipt of the Bird
described herein.

Seems pretty thorough to me! The only thing I could think of would be to hammer out exactly what and how much he eats, agree upon a reasonable amount of time out of cage for interaction, how often the cage will be cleaned ect. That way both parties are in agreement of the fids day to day care - it could be something as simple as the owner filling in blanks and then the foster initialing that they will do it within reason. Plus, it will give you a way to check that the foster is fulfilling their obligations. You may also want to include a clause for emergency care since you already have a clause that both parties will discuss/agree if a vet appointment is needed. Just a thought - I filled out a form when Petey was boarded with my vet that gave my permission for them to give emergency care if they couldn't reach me or if a quick decision was needed.

Perhaps in section B, write something like:

The foster carer will take all reasonable precautions to prevent the foster bird suffering from illness, injury or mental distress. Reasonable precautions are considered to be:
supervised out-of-cage time of no less than ________ per day
cage lining changed daily
full cage clean out weekly
constant supply of fresh clean water (to be changed at least daily)
constant supply of wholesome bird food with fresh food (vegetables / fruit) provided at least 5 times a week.

Should the foster bird begin to suffer from, or is in the opinion of the foster carer suffering from an illness, injury or mental distress during the period of foster care, the foster carer is to attempt to immediately contact the owner on the following number _________________. The foster carer is obliged to make a reasonable attempt to contact the owner to discuss care of the bird. Should the owner be uncontactable for what ever reason the foster carer is obligated to act in the best interests of the foster bird. If a vet appointment is deemed necessary by either the foster carer when contact with the owner was not possible, or as a joint decision between the foster carer and owner all vet expenses are to be covered by the owner. The foster carer will provide transport to and from the vet in an approved avian transport cage.

Where the foster carer has provided all reasonable precautions to prevent illness, injury and mental distress, the foster carer will not be considered liable to Owner or any other persons for any human or companion animal bodily injuries or illnesses, or any other damages, losses or injuries whatsoever in connection with the actions, behavior or health of The Bird or in connection with the Foster Home.

Recoupment limited to fair market evaluation to be determined by an independent expert
